1. Acceptance of Terms

By using the Moveham app, users acknowledge that they have read, understood, and agree to be bound by these Terms & Conditions. These terms govern your access to and use of our e-hailing services and Moveham Marketplace.

We may update these terms from time to time. We will notify users of material changes via in-app message or email where possible. Changes become effective immediately upon posting on the platform. Continued use of our services after changes constitutes acceptance of the updated terms.

2. Eligibility

  • Age Limits: Riders must be at least 18 years old. Drivers must be at least 21 years old. Guardians may create and use an account to book rides for minors under 18, but the guardian remains fully responsible.
  • Valid ID: A valid government-issued ID (e.g., driver's license, passport, national ID card, voter's card) is required.
  • Account Ownership: Users must create an account in their own name and provide accurate information. Accounts are non-transferable and account sharing is prohibited. We may use biometrics, OTP verification, or other measures to enforce this. You are responsible for keeping your login credentials confidential and must notify us immediately at support@moveham.com of any unauthorized use of your account.

3. Services Provided

Moveham is an e-hailing technology platform that connects riders with independent Driver Partners, enabling riders to request on-demand rides or schedule rides in advance. Moveham also operates Moveham Marketplace, connecting independent store owners ("Sellers") with buyers for the purchase of goods through the platform. See Section 18 (Moveham Marketplace) for details.

Service Areas: Services are currently available in Lagos State (Ibeju-Lekki and Epe Axis). We may expand or modify service areas at any time with notice where practicable.

4. User Responsibilities

Users must provide accurate and truthful information. Riders must provide correct pickup and drop-off locations. Multiple offenses of providing false information may result in account suspension or permanent ban.

You agree not to:

  • Impersonate any person or misrepresent your affiliation with Moveham

  • Other items that may be hazardous or pose a risk to drivers, users, or the public

Note: Users are responsible for insuring valuable items such as cash or jewelry.

6. Fees & Payments

Fare Calculation

Fares are calculated using a base fare, per-kilometer rate, per-minute rate, distance, and duration, with a minimum fare where applicable. An estimated fare is shown before confirmation.

Surcharges

We do not apply surge pricing. Tolls, taxes, and other applicable fees may be added where necessary.

Taxes

These include automatic trip sharing with trusted contacts, real-time trip tracking, shake-to-send emergency alerts, and incident reporting. Riders can also verify trips using a secure PIN shared with the driver before the journey begins. Drivers are required to carry valid insurance, and users are encouraged to actively use these safety tools. In the event of any incident, users should contact support immediately.

13. Liability Disclaimer

Platform as Facilitator: Moveham is a technology platform connecting riders with independent Driver Partners. We do not provide transportation services ourselves.

Service Provided "As Is": The app and platform are provided on an "as is" and "as available" basis. While we take reasonable steps to verify Driver Partners, we do not guarantee uninterrupted, error-free service, and to the fullest extent permitted by Nigerian law, we exclude liability for indirect, incidental, or consequential loss (including lost profits or data) arising from use of the platform.

Limited Liability: Our liability is limited to the fare paid for the specific trip, except in cases of gross negligence or willful misconduct by Moveham. Drivers are responsible for their own insurance and compliance with Lagos State regulations. We are not liable for driver actions, delays, or incidents beyond our direct control.

14. Account Suspension & Termination

We may suspend or ban users for violations including low ratings, misconduct, safety risks, fraud, or false information:

  • Violate these Terms
  • Harassment, abuse, or discrimination
  • Safety risks or reckless behavior
  • Fraud or platform manipulation
  • Consistently low ratings (below 4.0 for Drivers, below 3.5 for Riders)
  • False documentation

Banned users may appeal the decision via support@moveham.com within 7 days. Wallet balances will be handled fairly where possible (subject to verification). Refunds for banned accounts are at our discretion.

15. Privacy & Data Protection

We collect and process personal data (including location data) in accordance with the Nigeria Data Protection Act 2023 (NDPA). Please review our Privacy Policy for details on data handling, consent, rights, and security measures.

16. Governing Law & Dispute Resolution

Applicable Law: Governed by the laws of the Federal Republic of Nigeria.

Dispute Resolution: Disputes should first be resolved via in-app support, then email to support@moveham.com. If unresolved, both parties will attempt to settle the dispute through good-faith negotiation for up to 30 days.

Mediation & Arbitration: If negotiation fails, the dispute may be referred to mediation at a recognized mediation center in Lagos, and if still unresolved, to binding arbitration under the Arbitration and Mediation Act 2023, seated in Lagos, Nigeria, conducted in English before a single arbitrator. For consumer disputes, users retain the right to approach appropriate courts in Nigeria as permitted by law.

17. Miscellaneous

Force Majeure: We are not liable for delays or failures due to events beyond our reasonable control (e.g., natural disasters, strikes, or government actions).

Indemnity: You agree to indemnify and hold Moveham, its affiliates, officers, and employees harmless against claims, losses, or expenses arising from your misuse of the platform, your negligence, your breach of these Terms, or your violation of any law or third-party right. Driver Partners further agree to indemnify Moveham against claims arising from their provision of transportation services, including any insurance, licensing, or negligence-related claims.

Intellectual Property: All content, logos, and app features are owned by Moveham or its licensors. Unauthorized use is prohibited.

Severability & Entire Agreement: If any provision is invalid, the rest remain enforceable. These terms constitute the entire agreement.

18. Moveham Marketplace

Marketplace Overview

Moveham Marketplace connects independent store owners ("Sellers") with buyers ("Buyers") on the platform. Moveham acts solely as an intermediary and technology facilitator between Buyers and Sellers, and does not itself manufacture, own, or take title to any goods listed for sale.

Escrow & Payment Flow

When a Buyer purchases an item, payment is collected and held securely by Moveham via the MovePay wallet rather than being paid directly to the Seller. The Seller is notified of the order and the item(s) purchased. Funds are released to the Seller only after the Buyer confirms delivery and releases payment.

Buyer Cancellation

Buyers may cancel an order and request a refund at any time before releasing funds to the Seller. Once funds have been released to the Seller, the transaction is final. See our Refund Policy for details.

Commission & Fund Disbursement

Moveham charges a total commission of 5% on the value of every purchased good, deducted from the held funds before disbursement. Once released by the Buyer, the balance is paid directly to the Seller's registered account.

Prohibited Goods

Illegal goods, counterfeit items, and any goods prohibited under Nigerian law are strictly forbidden on Moveham Marketplace (see also Section 5, Prohibited Items). Sellers found listing such items are subject to immediate suspension and removal, and Moveham reserves the right to report unlawful activity to the relevant authorities.
